In this Agreement unless the context clearly indicates a contrary intention, the words herein below defined shall have the meanings assigned to them, and similar expressions shall bear corresponding meanings:

[Activation] means the enabling of the Quick Cash software on the designated system by Quick Cash to enable the Subscriber to operate the Quick Cash application processing interface in terms of this Agree ment;

[agreement] means collectively the Schedule and these terms and conditions of business;

[charges] means the Setup Fee Monthly Service Charges Usage Charges and any other charges pertaining to the provision of Quick Cash Services and other services howsoever described by Quick Cash to the Subscriber the provision of Quick Cash Services and other services howsoever described by Quick Cash to the Subscriber as detailed in the Price List from time to time and as agreed with the Subscriber as detailed in the Price List from time to time; and/or as agreed with the Subscriber.

[ Setup Fee] means the charge levied by Quick Cash to the Subscriber for Activation of a Subscriber to the Quick Cash Services

[Bank] shall mean the bank to which Quick Cash is sending the credit card transaction for authorization and settlement on behalf of the Subscriber;

[Subscriber] means that party whose particulars appear on the Schedule;

[Quick Cash] shall mean Quick Cash Proprietary Limited Registration Number a private company registered in accordance with the laws of Qatar;

[Quick Cash Website] means the website available at https://qcash.qa;

[Service Charges] means the subscription charge levied by Quick Cash in consideration for the Subscriberʼs access to and use of the Quick Cash Services as detailed in a Price List from time to time;

[Effective Date] means the date on which Quick Cash accepts the Subscriberʼs Order;

the payment processing services which Quick Cash makes available to the Subscriber including any of the Quick Cash payment solutions including Value Added Services, as set out on the Quick Cash Website;;

[Order] means an order placed by a Subscriber as per the Schedule the provision of the Quick Cash Services;

[Package] means any one of the tariff plans under means any one of the tariff plans under which the Quick Cash Services are made available to Subscribers, which tariff plans are set out in the Price List and may vary according to the rate of Usage Charges, Value Added Services included and other variables determined by Quick Cash from time to time,

[Price] means the schedule on which the charges levied by Quick Cash as approved are recorded as amended from time to time on prior written notice to the Subscriber which price list is available on request from Quick Cash;

1. Access to the Service

* Any company or person (a User) accessing, receiving or otherwise using any of Quick Cashʼs services (the Services) is responsible for complying with all applicable laws, by-laws, regulations, rules or orders regarding such access, receipt or use of the Services

* The User also agrees to adhere to the terms of Quick Cashʼs Fraud Module Terms of use, which may be amended from time to time by way of updating a revised version on Quick Cashʼs website

2. Definition

Quick Cashʼs Fraud Module is provided as a tool to help flag or block a credit card transaction according to the fraud configuration enabled by the merchant.If a transaction is configured to be blocked, the transaction will not be processed for authorization. If a transaction is configured to be flagged, the transaction will be processed for authorization.

3. Delivery of Q-Cash Fraud Module Services

Quick Cash shall utilize its best endeavours to promptly comply with any supply of its Fraud Module services as designated and configured within the Fraud Module recorded in the order, but shall not be liable to the Subscriber in the event that such supply and/or delivery and/or is delayed or cancelled, for whatsoever reason. The Subscriber waives all and any claims from whatsoever cause arising against Quick Cash or any other party arising out of the provision of these services.

If for any reason you decide to not proceed

If you have applied for a Quick Cash account and paid a setup fee, then decide to not proceed within 30 days of your registration, providing you give us immediate notification in writing to the email address specified on our website, you will not be liable for any further fees.

If we cannot offer you our services

There can be cases when Quick Cash is unable to provide our services to all businesses, for example, operational, location, legal, regulatory, reputational, or risk reasons. If, (other than as a consequence of your own acts or omission) after our initial assessment of your application, we decline to offer you an account we shall refund any monthly charges paid by you in advance to the date of notification of decline. Sharing information with Schemes Visa international Limited, MasterCard Inc, member banks and payment processors share information on businesses, registered directors, web domains and their prior trading histories. Failing to disclose information that may effect our initial assessment can result in your application being declined after we have spent time working on it. If you have failed to disclose all appropriate information to us your Application Fee will be retained to cover our costs.

If we have processed your application

If we have processed your application, accepted you as a merchant and your account has then been set live, then we will not return the setup fee, charges and any unpaid balance for the first 24 months service charges will become immediately due and payable.

If you terminate your contract

If you wish to terminate your contract you should give us written notice as per the terms in your contract with us. If you fail to send us this notice of termination in accordance with your contract. Upon termination by you for whatever reason all fees and Charges already incurred and payable under your contract become due

System Security Policy

Quick Cash is a payment service provider that process transaction for thousands of merchants. We take system and data security extremely serious and ensure that our customerʼs transactional data is secure within our environ- ment at all times.

Transaction security

Quick Cash uses SSL certificates to ensure that all transactional information is passed securely between the merchant and Quick Cashʼs site. No cardholder information is ever passed unencrypted and any messages sent to your servers from Quick Cash are signed using MD5 hashing to prevent tampering. In the event that PAN information is returned, the PIN will be hashed, including the first 6 digits and last 4 digits of the PIN.

Encryption and Data Storage

All sensitive data is secured stored within Quick Cashʼs systems using internationally SSL bit encryption standards. The data we hold is extremely secure and strict policies in place ensuring limited and secure access to our servers internally are maintained.

System security

Quick Cashʼs systems are regularly scanned ensuring that our infrastructure and network remains secure at all times. Further to this, we use an Approved Scanning Vendor approved by the payment card brands to review scans quarterly. Additionally, Quick Cash is Banking Level 1 certified, which is the highest level of compliance. As a service provider that stores and transmits cardholder data on behalf of our merchants, Quick Cash will maintain all applicable requirements in accordance to Qatar regulations in order to protect the integrity of our merchantʼs cardholder data.

Staff validation

All employees at Quick Cash are checked for Criminal Records prior to employment and no unauthorized individual has access to or is able to decrypt transaction information or cardholder data. Our systems only allow access to our most senior staff and only in extenuating circumstances (such as investigations of Card Fraud by the Police). All transaction information and customer card information is secure even from our own employees.
